Minutes of Witham St Hughs Parish Council Extra-ordinary meeting held on Tuesday 8th February 2024 at 6.20pm at the village hall.

Present Cllr Karen Harrison – Chair, Cllr Danny Bell – Vice Chair & Cllr Derek Fletcher.

Agenda Items

1.   Welcome & Apologies.

The Chair welcomed everyone to the meeting.

2.   TO RECEIVE DECLARATIONS OF INTEREST IN ACCORDANCE WITH THE LOCALISM ACT 2011 AND OUTLINED IN THE COUNCILS CODE OF CONDUCT – being any pecuniary interest in agenda items not previously recorded on Members’ Register of Interest and any written requests for dispensations.

None 

3.   To review and amend the Terms & Conditions for the Allotments. 

After discussions it was Resolved to add in the following clause to the Terms and Conditions, All Agreed – show of hands. 

Tenants must not do nor allow anything (in relation to the tenant’s plot) which is inconsistent with, or in breach of, the provisions of Witham St Hughs Parish Council’s Land Lease Clause 1.1, which states - 

1.1 - Use of the Property

a.             not to use or permit the use of the Property: -

•   other than for the purposes of the Authorised Use.
•   in such a way as may be or grow to be a nuisance or annoyance to the Landlord or its      tenants or occupiers of adjoining or neighbouring property or of any other third party.
•   for any business trade or other commercial activity.

b.     Current prohibited items listed is not an exhaustive list and any items deemed by the   Parish Council and its Allotment Committee to be causing a nuisance or annoyance to the landlord or occupiers of adjoining or neighbouring property will be considered as prohibited and the tenant in breach will be asked to move said items.  If not removed within 14 days tenant will be in breach of contract and thereafter the enforcement process will commence

This clause is to be read in conjunction with the Witham St Hughs Dignity at Work Policy.
